Setpilot Terms of Use

Setpilot is operated by Horizon Learning Solutions LLC from 1209 Mountain Rd Pl NE, Ste N, Albuquerque, New Mexico 87110, United States.

You must be at least 18 years old and use Setpilot as a business, professional or authorized representative of an organization. You represent that you have authority to accept these Terms and to connect any Instagram account, calendar or other service used with Setpilot.

Setpilot helps businesses configure, test, publish and supervise AI agents for commercial conversations. Depending on the features enabled for an invited account, it may provide a simulator; connect professional Instagram accounts; receive supported direct messages, comments, stories or other messaging entries; generate and send authorized replies; support comment-triggered direct messages where the customer's configuration and Meta permit them; and provide CRM, follow-ups, authorized resources, metrics, human review and Calendly scheduling when the customer connects that service.

Setpilot does not guarantee that generated output is correct or that use of the service will produce any particular number of meetings, sales, customers, revenue or other commercial result.

You must provide accurate information, protect your credentials and keep user permissions current. You are responsible for activity performed through your account.

You may connect only accounts and services that you are authorized to manage. Connected services remain subject to their own terms and policies. Meta and other providers may change, restrict or withdraw APIs, permissions or accounts outside Setpilot's control.

You are responsible for:

• Configuring and testing your agent before broader use.
• Reviewing instructions, commercial rules, examples and authorized resources.
• Supervising conversations in a manner appropriate to your risk and business.
• Providing legally required notices about automation or artificial intelligence.
• Maintaining an appropriate privacy policy and lawful basis for processing contact data.
• Responding to privacy requests relating to conversations for which you act as controller.
• Complying with applicable laws and the policies of Meta and other connected services.

AI-generated output may be inaccurate, incomplete, delayed or unsuitable for a particular situation. You must configure and supervise Setpilot based on your business, legal obligations and risk profile.

You may not use Setpilot to make fully automated high-impact decisions about employment, credit, housing, health, education, insurance or essential services without an appropriate legal assessment and meaningful human involvement.

You must not configure an agent to deny its automated nature or impersonate a specific person when someone directly asks whether they are interacting with an AI system.

You may not use Setpilot to:

• Send unlawful spam, harassment, threats or deceptive messages.
• Impersonate a person or organization without authorization.
• Collect or process data without a valid legal basis.
• Violate privacy, intellectual property, confidentiality or other third-party rights.
• Distribute malware or interfere with service security.
• Evade restrictions imposed by Meta, Instagram or another connected provider.
• Access or connect an account without authorization.
• Resell or sublicense Setpilot without written permission.
• Use the service for illegal or fraudulent activity.
• Introduce sensitive personal data unless it is necessary, lawful and appropriately protected.

You retain your rights in the information, instructions and content that you provide or connect to Setpilot.

You grant Horizon Learning Solutions LLC a limited permission to host, copy, process and transmit that content only as reasonably necessary to provide and secure Setpilot, resolve incidents, follow documented instructions and comply with legal obligations. You represent that you have the rights and permissions required for that content.

Personal data is also handled under the Setpilot Privacy Policy.

Setpilot, its software, interface, documentation, trademarks and related service components belong to Horizon Learning Solutions LLC or its licensors. You receive a limited, revocable, non-exclusive and non-transferable right to use the service for your internal business purposes. No ownership of the software is transferred to you.

Setpilot may depend on Meta, Instagram, calendar services, artificial intelligence providers, hosting services and other third parties. Their services are governed by their own terms and may change or become unavailable. Horizon Learning Solutions LLC is not responsible for third-party decisions or events outside its reasonable control.

Setpilot is a commercial product whose registration is currently controlled by invitation. An invitation does not promise that every feature or integration is enabled for that account.

If an invitation includes the standard demonstration allowance, it lasts up to 7 days and permits up to 100 simulator messages. The demonstration allowance does not permit connecting Instagram or Calendly.

No payment method is collected and no subscription renews automatically under the demonstration allowance. Setpilot does not currently collect subscription payments through the service. Paid access, if offered, requires separate commercial terms before any charge begins.

We work to keep Setpilot available and secure, but we do not guarantee uninterrupted or error-free operation. We may correct errors, update integrations, apply reasonable limits, suspend features for security or maintenance, or withdraw functionality that depends on a third party.

We may restrict or end access when these Terms are breached, use creates a security or legal risk, a connected provider withdraws required permissions, or continued access could harm Setpilot, another person or a connected platform.

You may stop using Setpilot at any time. Ending access, disconnecting an integration, deleting a contact, deleting a project and closing an account are different actions from an explicit commercial cancellation. Account closure and deletion requests are available in the product and through contact@setpilot.net; their data effects are described in the Privacy Policy and deletion instructions.

When Setpilot records an explicit commercial cancellation without a deletion instruction, the project becomes inoperable and its data is held for a reactivation period of no more than 90 days. An explicit reactivation before deletion starts cancels the scheduled purge. A verified deletion instruction takes priority and does not wait for that period.

To the fullest extent permitted by law, Setpilot is provided on an "as available" basis. We do not guarantee the accuracy of AI output, continued availability of third-party APIs, continued access to a Meta account, or any specific commercial outcome. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.

To the fullest extent permitted by law, Horizon Learning Solutions LLC is not liable for indirect, incidental or consequential losses, lost profits, lost opportunities, reputational harm, or losses caused by decisions made solely from AI-generated output or by third-party platform restrictions outside our reasonable control.

Subject to the sentence below, our total aggregate liability for direct damages arising from the service will not exceed the lesser of the amounts the customer actually paid to Setpilot during the 12 months before the event giving rise to the claim and US$50. If the customer paid nothing during that period, the cap is zero.

Nothing in these Terms limits liability that cannot be limited under applicable law.

You are responsible, to the extent permitted by law, for claims and costs resulting from your unlawful use of Setpilot, unauthorized connected accounts, customer content, violation of third-party rights, or failure to meet your privacy and platform-policy obligations.

We may update these Terms as the law or service changes. We will publish the revised Terms with a new effective date and provide additional notice when reasonably required. Continued use after the effective date constitutes acceptance where permitted by law.

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules. Disputes will be submitted to a court with jurisdiction in New Mexico, subject to any mandatory rights or procedures that applicable law does not allow the parties to exclude.
